Terms of Service

Welcome to Zera Health. These Terms of Service ("Terms") govern your use of the Zera Health website, mobile application, and telehealth services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Telehealth Services
Zera Health provides a platform that connects patients with independent, licensed physicians and healthcare providers ("Providers") for telehealth consultations. All medical services, diagnoses, and treatment decisions are made solely by the licensed Providers, not by Zera Health as a company.
- Providers are licensed to practice medicine in the states in which they see patients.
- Telehealth services are not a substitute for in-person emergency medical care.
- If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
- The information you provide during intake and consultations must be accurate and complete. Providing false or incomplete information may affect your care and eligibility.
2. Prescription Decisions
Prescription decisions, including whether to prescribe a medication and what medication to prescribe, are made solely at the discretion of your licensed Provider. Zera Health does not guarantee that a prescription will be issued. Eligibility for prescription medications depends on your medical history, health status, and your Provider's independent clinical judgment.
3. Not Emergency Care
Our Services are not designed for emergency medical situations. Do not use Zera Health if you are experiencing a medical emergency. The Services are intended for non-emergency, routine, and preventive health needs. Zera Health is not liable for any consequences arising from a patient's failure to seek emergency care.
4. Refund Policy
- Full Refund: You are entitled to a full refund within 7 days of your initial purchase if your case has not yet been reviewed by a Provider.
- No Refund After Prescription: Once a prescription has been issued and sent to a pharmacy, no refund will be issued for that consultation or medication cycle.
- Subscription Refunds: Monthly subscription fees are non-refundable once a billing cycle has begun, except as required by applicable law.

5. Subscription and Cancellation
Zera Health offers subscription-based services billed on a recurring basis. You may cancel your subscription at any time by:
- Emailing hello@zerahealth.org with your cancellation request.
- Calling us at (786) 340-8244.
Cancellations take effect at the end of the current billing period. You will retain access to Services until that date. We do not provide prorated refunds for unused portions of a billing period.
6. Prohibited Uses
You agree not to:
- Provide false, misleading, or incomplete information during registration or consultations.
- Use the Services for any unlawful purpose or in violation of applicable laws.
- Attempt to gain unauthorized access to any part of the platform or another user's account.
- Reproduce, distribute, or create derivative works from our platform content without written permission.
- Use automated scripts, bots, or scraping tools to access our Services.
- Harass, threaten, or abuse Providers or Zera Health staff.
7. Intellectual Property
All content on the Zera Health platform, including but not limited to text, graphics, logos, images, and software, is the property of Zera Health or its licensors and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute our content without our prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Zera Health, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Services, even if Zera Health has been advised of the possibility of such damages.
Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to Zera Health in the 3 months preceding the claim.
9. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free service.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on our website. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
